These Terms of Service apply to your use of quellsleep.com (the "Site") and to any order you place with us. The Site and the QUELL brand are operated by QUELLIES LLC, a Wyoming limited liability company, of 36 N Gould St Ste R, Sheridan, WY 82901, United States ("QUELL", "we", "us"). By using the Site or placing an order, you agree to these terms.
Who can order
You must be at least 18 years old, or have the permission of a parent or guardian, to place an order.
Orders
When you place an order you make an offer to buy. We accept the offer when we send the shipping confirmation. We may refuse or cancel an order, for example if an item is unavailable, if there is an error in the price or description, or if we suspect fraud. If we cancel an order you have already paid for, we refund you in full.
Prices and payment
Prices are shown in US dollars and may change without notice. Shipping is shown at checkout before you pay. Applicable taxes are added at checkout. Payment is processed securely by our payment providers. We do not store your card details.
Discount codes
Discount codes cannot be combined with other discounts unless we say so, have no cash value and can be withdrawn at any time. A sign-up code can be used once per customer.
Products
We do our best to show colors and details accurately. Colors can look slightly different from one screen to another, and soft fleece items can vary slightly from one piece to the next. Sizes are described on each product page.
Shipping, returns and defects
Shipping is covered by our Shipping Policy. Returns and refunds are covered by our Returns Policy. Manufacturing defects are covered by our Defects Policy. All three are part of these terms.
Safe use
Our suits are loungewear and costumes cut for adults and teens. They are not children's sleepwear and are not made in children's sizes. They are not treated to be flame resistant, so keep them away from open flames, heaters, stoves, candles and any other heat source. The hood reduces your field of view, so take it down on stairs and never wear it while cycling or driving. Follow the care label.
Your conduct
You agree to give accurate information when you order, and not to misuse the Site, for example by interfering with its operation or by using it for anything unlawful.
Reviews and content you post
Reviews shown on the Site are from real customers. If you send us a review or a photo, you confirm it is your own honest experience and you give us permission to publish it.
Intellectual property
The Site and its content, including text, images, designs, character designs and logos, belong to QUELLIES LLC or its licensors. You may not copy or reuse them without our written permission.
Limitation of liability
To the extent permitted by law, our liability for any claim related to an order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses. Nothing in these terms limits rights you have under consumer protection laws that cannot be waived, and nothing limits our liability for death or personal injury caused by our negligence.
Governing law
These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of laws rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in Sheridan County, Wyoming. This does not affect any mandatory consumer rights you have where you live, including the right to bring a claim in your own local courts where the law gives you that right.
Changes
We may update these terms from time to time. The version posted on the Site at the time of your order applies to that order.
